Legal Question in Family Law in California

Modifying Parenting Plan

I currently have a parenting plan that was filed in 2000. I was offered a job promotion with my current company which would take me out of state. How would I change the one sentence in the parenting plan that states ''neither parent shall change residence of minor children with out written consent of the other parent or further order of the court'' without changing anything else that was previously agree in 2000?

Re: Modifying Parenting Plan

The first thing to do is seek agreement from the other parent. Absent such agreement, you will need to file a request for a move away with the court. You may not just alter the judgment without agreement of the other party or further order of the court. This may be a very contentios issue and is certainly a complex issue. I striongly advise that you seek legal counsel.

You would need to modify this provision in writing with the court in order for it to take precedence over the pre-existing order. For prompt, affordable legal assistance here, contact us directly for a free phone consultation.
