Legal Question in Family Law in California

Moving a child away from other parent

If my ex-wife moved from California to Colorado, who has to pay for the airfare. We have joint custody, but obviously my daughter is with me less. She has been paying and now says I have too. I continue to pay child support every month and have never missed a beat in 10 years.

Re: Moving a child away from other parent

That is an issue for a court to decide, based upon all factors. There is no rule and the decision might vary from judge to judge. I think it worthwhile that you get an opinion of an attorney who practices in the court that has jurisdiction over the child support issue. (The same court that made the previous order.) If you have not had a modification of support for 10 years, there may be a substantial increase in support coming your way if your ex-wife takes you back to court. It may be cheaper to keep her happy by paying the transportation. Good Luck, Pat McCrary
