Legal Question in Family Law in California

moving out of state with my son, help!!

my fiance lives in new mexico due to his job. i have a two year old son from a previous marriage, whom i have full pysical and legal custody of. his father, the past few months has been trying to be a good dad, but only when he thinks i am single. we live in cali right now, but in a few months i want to move in with my fiance. i have a chance to give my son a better life there than i can here. i dont know the legal issues behind me trying to leave the state. i am afraid to tell my ex, he is also bipolar, and has a history of being put in the mental facilities here. can he keep me from leaving the state with my son? i am scared he is going to try to take him from me. do i have to be married before i can leave? is there any way my ex can keep me from leaving? i am so worried. please help!!

You should hire an attorney right away and set a strategy for leaving. It sounds like you have a good chance at prevailing, but I wouldn't risk making any mistakes.
