Legal Question in Family Law in California

ex party

My husband and I separated almost 2 years ago. I have had custody and he has had weekend visitation with no formal arrangements in place. I dropped off my special needs child with him due to illness so his mother can watch him. Now he refuses to give him back. I am filing exparty on tuesday with no lawyer because I can not afford one. Will this be a bad thing? Sombody help. He told me I could only see my son if I peered through the screen at his apartment. I have not seen him in 3 days now. I have had the major responsibility for both children since separation.
