Legal Question in Family Law in California

Who pays for Childs health insurance ?

In my divorce decree it says that while my ex-husband works at a company that provideds health insurance he must have our daughter covered. is company no longer pays for her insurance so I now pay it out of my pocket and he refuses to help. Does he legally have to pay for her insurance? My daughter and I are going to Mexico in October do I need his permission to take her? I have primary custody of her. He says that he will sign any paper necessary for me to take her to Mexico as long as I sign a paper for him letting him take her to Mexico. If I sign a paper agreeing to that I'm I legally obligated to it even if my daughter at tthe last minute(were) to refuse to go? Thank You

Re: Who pays for Childs health insurance ?

both parents are responsible for the health care costs of their children. If he has medical insurance available through his employer for little or no cost he must provide that insurance.

If you agree to allow him to take her to Mexico and then back out the court will take a dim view of this conduct. You would be better off to just file a motion with the court requesting a court order that you can take her to Mexico. You will have to provide a very good reason why he should not allowed to take her to Mexico.
