Not a losing battle, but not an easy victory either. Many factors are considered in move away cases and not just your job opportunity or motive for moving. One important factor is the current visitation to your ex. Any prior domestic violence is also important. The primary focus is on the child and the detriment (or lack thereof) that the proposed move would have. Will your child still be able to visit the other parent? How will travel costs be allocated? Often a 730 evaluation is appropriate so that a 3rd party can provide input. Be aware, 730 evals are not quick and they can be expensive!
