Legal Question in Family Law in California

reversing restraining orders/ enforcing custody orders

how do I fight a restraing order obtained on false accusations? My ex-husband has primary custody if our son. I am, by the court, appointed scheduled phone calls, specified weekends, and other rights of that nature. He misses phone calls, starting to not give me my child on my scheduled days. He knows with a restraing order in effect against me I cannot obtain police help to enforce the court orders as it is stated ''under no circumstance can they help the accused(me) in any way, for any reason. He is in process of renewing a current order against me.He files then comes over to my house to see me the next day, takes me to hotels, wrtes me love letters he sends through the mail. How can I fight this or show just cause on why it SHOULD NOT be granted and how do ensure I get my time indicated,if not modified, with my son?

You should retain an experienced child custody attorney to assist you in putting together your case. He can appropriately present all of the facts to the court so that you can obtain an appropriate order. Good Luck, Pat McCrary
