My son has taken his ex to court for custody and was awarded 50% custody the childs mother had filed in a different couty at a later date for the same thing. Can she do this?

The answer to your question can depend on what the 'competing' courts find was the appropriate court location between them (whether county or state) to exercise power of the decisions of the child and render a decision regarding same. Sometimes 'first in time' doesn't necessarily mean that the decision rendered by the court will necessarily hold, if it is determined that another court was the more appropriate court to have the matter in the first place to render decisions regarding the child.
