Legal Question in Family Law in California

My son married a girl from Russia. She came to the USA and got pregnant. She went home to Russia for a visit and did not return. She had the baby in Russia. My son is on the birth certificate as the father. My question is: is the baby an american citizen because the father is american? When she became pregnant they were living in California. He now resides in Tennessee

Your grandchild probably has dual citizenship. He is a U.S. citizen because his father is a U.S. citizen. Whether he is a citizen of Russia depends upon the laws of Russia. When he reaches the age of majority he will need to make a choice as to which citizenship he wants as the U.S. does not recognize dual citizenhip of adults. Good Luck, Pat McCrary
