Legal Question in Family Law in California

Termination of Child Support

The county of LA wants me to pay child support for the complete month of June - I contend the month of June should be prorated as full time HS ended June 11th with graduation ceremony on June 17. Commisioner continued - requests I submit points and authorities - any cases worth citing you know of?

FC 3901 (a) says child support ends at age 18 or, if in high school full time, when the child completes the 12th grade. I mentioned the above, apparently not enough for the court.

Re: Termination of Child Support

Child support is most often due on the first day of the month. Once the due date passes the child support has accrued. Once the child support accrues the amount cannot be changed by court order. Unless you are paying an extremely high amount for child support your cheapest solution is to just pay the support. Then move on with your life.
