Travel Permission from Incarcerated parent

How can I obtain a travel visa for my child when the father is incarcerated and I need his permission to travel. It has never been necessary to go to court to obtain legal custody since the father has never asked for any parental rights such as visitation or shared custody.

Are inmates allowed to give their permission, or do i need a judges order?
