Legal Question in Family Law in California

Unmarried w/child Custody &Eviction?

I'm unmarried, living with a man for 9 years. We have a 5 year old daughter. Things have been very rocky, he's become controlling and almost obsessed with our daughter. He gets up early on weekends and sneaks out to go to his parents, doesn't ever allow me to spend time with her without me almost begging. He tries to make her feel guilty for not spending time with him. I want him out of the house (i'm on the lease, he never was) To avoid confrontation in front of the kids, I have been bowing down to him. I am really tired of it. I have no say so in her life at all. I feel beaten down and just worn out, but very tired of letting him get the best of me. He threatens to take her and keep her away from me by getting a high powered lawyer that his parents are willing to pay for. I have no idea where to start to get him out without him hurting me or making a scene in front of our child an/or my other 3 kids. I don't have a lot of money for an attorney because I pay all of the bills. I'm really worried that he may hurt me and if not, really scare the kids by making a scene. Do you have any suggestions for me? I certainly don't mind sharing custody, I just want him gone and my daughter and my life back.

I would file an OSC requesting that he be forced to move out, and I would file an ex parte request for custody. If he is controlling and manipulative, you need to get an attorney. Go to your local bar association and see if they have any advice for how to get an attorney to work for you for free, or for a reduced cost. Otherwise, I'd borrow the money if I was you. When the other side is manipulative and controlling and already making threats, you don't want to handle this on your own.
