unpaid child support/ custody of son

My son is 11 yrs old now, my ex-husband sees him 2 x a year ,he is 38;000 behind in back child support, he is now married and wants custody, how hard is this going to be? I am a single mom. our son refuses to live with his dad.

I've seen cases like this before. Usually, a dad who wants to get out of child support will go after custody. You need to fight this from the very beginning. Dad's who go after custody to get out of paying support will lie in order to accomplish the deed. If you can't afford an attorney, go to a local bar association and ask for a referral to an attorney who will work pro bono. Do not take this lightly. If you walk in without an attorney, and if he lies, you stand a good chance of losing your son. I have counseled several women who have gone through this because they thought that if they just showed up and talked to the judge, they wouldn't lose custody. On cases where I was involved from day one, the action was stopped. Please get an attorney.
