Legal Question in Family Law in California

Vacation without Child after divorce

I'm a divorced Dad in California. My 7 year old daughter splits time 50/50 between my ex wife's house and mine. I asked my ex wife if she would mind taking care of our daughter during a 10 day vacation I had planed for this month. My ex and I spoke about the vacation in early February and she confirmed that she would take care of our daughter during my vacation. I purchased airline tickets after she and I spoken in February. She now says she will not watch my daughter per our verbal agreement.

Do I have any recourse? My divorce custody order clearly spells out vacation time with my daughter in great detail--yet it says nothing about me going on a vacation without my daughter. Do I need an addendum added to the custody order which clearly spells out separate vacation time for myself and my ex?

Re: Vacation without Child after divorce

You should have obtained written confirmation of your agreement. Otherwise you will have to go to court to get the order changed.
