Legal Question in Family Law in California

My wife and I are getting a divorce and my father lent us money during the marriage for a down payment to buy a home. No paperwork or interest but we put his name on title. The house lost value and we short sold losing all the money. Now we are getting a divorce... does the community have the obligation to repay my father? Part 2... he has passed away since separation, does that affect the debt/obligation of the community?

Technically it is a community debt, if the community borrowed the money from your father, and the fact that he passed away does not affect the fact that the debt is owed. It would just be owed to the estate. Is this something though that your father's estate is really concerned with?
