Legal Question in Civil Litigation in California

My 72 year old father was badly beaten ( he almost died...heart stopped 2 times at scene and again in ambulance on the way to the hospital) by a man after a high school baseball game. What type of attorney should we contact to sue this man? The district attorney is reviewing the case for charges of battery with intent to cause great bodily harm and elder abuse.

You want an attorney who handles personal injury cases and who shows some imagination in deciding whom to sue. The man who beat your father up would not be covered by any type of insurance since the incident was neither related to his car nor his house and was intentional and not negligent. So unless he has a lot of assets, you are not going to get much money form him. An investigation has to be made as to wheher security at the game was lax, did the man have a history of violence that the school knew about, did he act violent for some time but security did nothing about it, etc. If you are going to sue a public entity you must first file a claim with them within 180 days of the incident.

I hope your father is feeeling much better. Good luck.

This is a case for the personal injury attorney. They will take the case for 1/3 of the recovery, so you will not have to pay any hourly fees.

I agree with Mr. Shers. You want a good personal injury attorney, who also handles elder abuse cases.
