I Need an Attorney-Would Like Fee Estimation

Hello,

I was sued out-of-state and would like to file an answer with a motion to dismiss due to improper venue. My finances are streched as a laid off airline worker- I'd like to know the approximate cost of an answer.

If I read your question correctly, you live in California and were sued in another state, but you do not say where. Your answer and motion to dismiss would have to be filed in the state where the complaint was filed, since California courts have no jurisdiction over cases pending in other states.

I suggest you re-submit this question in a form that explains in which state the action was filed. That way, you will hear back from attorneys who are actually able to help you and who know the procedures in that state -- knowledge which will better enable them to quote you a fee.

You should probably also explain more about the case and why you feel it should not have been filed in that state. Not all motions to dismiss are alike, and neither are all answers. Such information will enable the attorneys who respond to give you more reliable estimates of their fees and costs.

If I misread the question and if the case actually was filed in California, then I would still like more information before estimating a fee. Do feel free to contact me if this is a California matter.

Although you've received several answers to date, I must respond to advise that the state, county, and court where the case is filed will affect the ability of an attorney to quote a fee or assist you. For one, every county has a filing fee for an answer, and for a motion, and it is different for each county. To quote you a total price, including the fees paid to the court, we would need that information.

Additionally, as Mr. Hoffman mentioned, if you are being sued out of state, you must find an attorney licensed in THAT state to file the answer and be able to appear in court for the motion. You did not mention where that is, but law is jurisdictional, and you need a member of the state bar of that state to file and practice law in that court.
