Legal Question in Civil Litigation in California

Auto Body Shop

After getting in an accident my insurance company issued a check to a body shop to fix the damage. The body shop cashed the check before knowing if they could get the parts. Afterward my insurance company decided to total the car and the body shop will not give the check back. I had signed a work order but it was just so they had my info, there was know price breakdown or dollar amount for anything whatsoever on that workorder. it was blank. The body shop forged my signature on the check from the insurance company. The body shop refuses to give the checck back and is charging for storage and teardown which my insurance refuses to pay. What do I do? DO i have a strong case?

Re: Auto Body Shop

You should gather all of the documents you have and consult with an attorney. If you can prove that the check was forged you should be able to get a judgment against that body shop and the person forged your name on the check.
