a customer owes us money, can we go after treble damages and the payment if he is just refusing to pay. this is in san mateo county,ca

No, unless you can prove that the customer intended to defraud you at the time of the purchase. You may collect interest at the legal rate of 10% annually, however, if you should prevail at trial.
