Expert Witness Disclosure

Under CA state law, and aside from the general disclosure req'ts of witness qualifications and basis for opinion, are expert witnesses required to disclose their history of previous cases in which they have served as an expert witness?

State law does not require that this information be included in the expert witness disclosure, but the expert can be asked about her past testimony either during his deposition and/or at trial. She cannot be required to reveal cases in which she merely acted as a consultant and did not testify.

No. However, you are entitled to obtain this information if you depose the expert.

If you timely and properly notice the depo, make sure you include a document request in the depo notice.
