Legal Question in Civil Litigation in California

Hello,

I had a computer company ACER America send my laptop back to me after repairs. When I called to check the status of the delivery they said it had been delivered. I called Fed Ex who told me it was signed for. I asked them to send me a signature and they sent me one. The signature was a scribble and the name of the person that signed it is "D. Soskoe" my name is Denise Siscoe, I asked Fed Ex how if no one in my residence was home and a neighbor signed for it wouldnt the driver be required to get the name of the actual person signing for the package. How could a neighbor sign for my package using my name? They then told me that they are not at liberty to discuss the matter because Fed Ex is working for ACER and that ACER needed to release the claim to Fed Ex in order for them to even discuss anything. I then called ACER and they told me that the package has a signature, therefor they are no longer responsible and I need to make a police report. I am at a loss here, I believe Fed Ex is responsible for this error as they did not get the name of the actual person that signed for the package.. Is this a situation I can take them to court over?

You could sue in small claims court. Most counties have a small claims court clinic that will assist you in preparing for trial.
