Legal Question in Civil Litigation in California

Who is liable?

A friend moved in with me. Four days after moving in, she called and requested that I allow her to bring her father's dogs to my house for two days. I concented. After two days passed, I requested her to remove dogs on a daily basis. The following Monday, the dogs attacked and killed my emu, and my Airedale. Who is liable for damages and death of emu and Airedale? I never had an agreement with father, only daughter, which she said she was responsible for ALL care of dogs and refused to give me father's phone number. After incident, I contacted Dog Pound and was told to retain dogs for one month and then I could put a claim on dog ownership. She removed dogs after one month w/o my consent.

Re: Who is liable?

You're very lucky the dogs didn't hurt any people, or you would have been held liable too. As to your pets, I'm very sorry. You can sue the friend and her father for the value of the animals their dogs killed. You may also claim some emotional distress, but that would involve a lot more litigation. Good Luck.
