Legal Question in Civil Litigation in California

Pet possession

A year and a half ago someone gave me back a dog that we had previously shared and he had taken. He saw the dog one time (by accident) in Sep. of 2002, he has not attempted to support, provide vet care, or contribute to cost, ever, he has not attempted to see the dog nor contacted me regarding her welfare since Sep. 4, 2002. He now claims the dog is his and asked a mutual acquaintance what is up with her. Does he have any claim on my dog and how can I ensure that he won't take her away again, I love her and can't bear to lose her.

Re: Pet possession

Make sure the dog's license is in your name, as this is indicia of ownership. If he actually tries to come after the dog, you might be able to assert an ajister's lien for the cost of veterinary care, boarding, etc (assuming he is successful in proving his ownership)which might make him think twice. If your facts are correct and are believed, however, the dog is 100% yours by gift.

Re: Pet possession

Tell him that the only way to get the dog is by going to court. Be sure to have the dog licensed in your name. Also have all bills that you have paid.
