Legal Question in Civil Litigation in California

Restraing Order Against my Daughter

There is this girl who has been at odds with my daughters for quite some time. She is very manipulative. She some how got a temp restraining orders agaist my daughters. (she tried to serve them today but they are not at home and she keeps harrassing me...don't they have to do that in person?)They haven't done anything to her! In fact it is just the opposite. She has threatened ME with violence (said that she will ''pop a cap off in my a**'')and has trashed my home and vehicles with toilet paper and eggs. I just got out of the hospital a few days ago from almost bleeding to death from ulcers. I can't take this. I don't have a lot of money for an attorney...what can I do? Can I sue her for harrassment of me and my daughters? Please help! Thank you.

Re: Restraing Order Against my Daughter

You can sue her but it would be pointless because it's not likely that she has any money to collect. I suggest you call the police and report her behavior, including the harrassment and the vandalism of your property.

Re: Restraing Order Against my Daughter

You can probably get a restraining order against her if she is harassing you, but you would need specific instances and witness and something to substantiate it.

What happened at the hearing on your daughter's restraining orders? Was there even a hearing or did she just get a temp and a hearing date.

Send me an email if you want to talk some more.

I would suggest that you file a civil harrassment order against the girl. To quote a prior posting, you will need to show specific instances of violent behaivior or threats of violence.
