My former fiance confiscated a sex videotape taken of the two of us while in Paris, France. She has admitted in court paperwork that she stole the tape from me but refuses to give it back. What legal rights to the videotape do I have? She claims I videotaped her illegaly which is not true. (Notwithstanding that the video took place in France). Is there any way that I can get the videotape returned?? Is there any case precedence on this? After all, it is my personal property.

I think you have every right to get the videotape back after she has erased it. The tape is your personal property. But the images on the tape invade her right to privacy. You didn't say that she ever consented to being videotaped nor that she gave a written release for it.
