Sister helps move-furniture broken-liable?

My husband and I helped my sister move a antique dresser valued at $500-700. We were not paid anthing and there was no consideration given. It was a favor. There was almost a car accident and we had to abrubtly stop on the freeway. The dresser tiped and 3 drawers fell out onto the highway and were destroyed. Are we liable?

It depends. If you were driving too close to the other car or too fast or if you did something which could be argued to be unreasonable driving under the conditions, then you might be liable. If that happens, then your auto liability insurance will probably pay for it, minus your deductible.

On the other hand, if you were driving properly and some putz caused a dangerous situtation forcing you to slam on your breaks, then the putz is liable. Small claims court is the place for something like this. Good luck.
