Legal Question in Civil Litigation in California

slow or not good ?

I was hit by a car on my bicycle last

year and I ended up getting surgery

on my sholder. In Dec. he said he

was getting my recards fron Kieser

billing an we should have an answer

withen 4 or 5 months. last week I

called him because he hadent called

me and when we talked he said that

he had all of my bills and that they

did not look very high and he wanted

me to see his doctor to see if i

needed surgery. I told him again that

I had surgery and I wanted to know

if he had all of my recards but he

didnt. My question is what can I do ,

should I try a different attorney or

should I sue him?

It appears from what you have written that the attorney you retained has not paid much attention to your case. You have two years from the accident in which to file a lawsuit for your injuries. Otherwise, you will be barred from doing so.

If you have lost confidence in your attorney, you can substitute another for him. All documents in his file legally are yours, and they would be transferred to a new attorney.
