Legal Question in Civil Litigation in California

Small Claims Judgement

I took a party to a small claims court and lost. I want to know if I can pursue this matter further in a different court/county. I realize I cannot appeal the court decision in the county that court was held. I am in total dismay. I would like to sue in another county can I. The accident was in Butte Co. were the defendant lives I on the other hand live in Santa Clara Co. I filed a small claims case in Butte Co. and what a joke, just like the investigation went in regards to the accident. I just can't believe it. I like to now what people think is right and wrong. I'm in shock!!!!!!!!!

Re: Small Claims Judgement

You cannot re-litigate the case in another county. If you try to do so, your oponent can have the case thrown out and you can be sanctioned and subjected to a lawsuit for malicious prosecution.

Sorry I can't be more encouraging.
