Legal Question in Civil Litigation in California

small claims

I recently had my vehicle stolen at my apartment complex on 9/7/06. In my vehicle was my garage door opener which immediately after it was stolen, I asked management to change the code and supply me with a new opener, just in case whoever stole my vehicle came back to get into my garage. So they told me they changed the code and gave me my new opener which put my mind at ease just a little bit.Well on 9/11/06 I came home from work to find that my garage was wide open and everything I owned with value was gone , my dirtbike, all my tools, my work belt, saws, drills etc...I hold management completely responsible for what happened and would like to sue them in small claims court since I cannot afford an attorney at this time due to my recent situation. My question is, do I have a good case and how would I go about doing this. Any info would be greatly appreciated, Thanks The only thing is they didnt change the code

Re: small claims

In my opinion you don't have a case because there are only 256 codes and all the bad guys have to do is flip the switches one at a time.

Re: small claims

If you still have the beeper and you have an expert show that the beeper is set to the same combination as the old one, you might have a chance. Otherwise, as Mr. Stone says, it might be tough. You might make a claim with your renters' insurance carrier, though.
