Legal Question in Civil Litigation in California

Spousal abuse

I want to bring a lawsuit against my ex-husband who terrified my children and me with physical and mental abuse for sixteen years. He had no reason to do this. All my energy went into keeping the peace in our household. Now he is wealthy while I exist on social security as only income. Can you tell me please where I start?

Thank you,

Re: Spousal abuse

Sounds like you have completed your divorce and final judgment rendered. With that the court usually ends it's jurisdiction over spousal support issues. Likely have child support available, however till kids of age or through college. Re: assault and/or battery, statute of limitations very short, probably one year based on info provided, but call to discuss.

Re: Spousal abuse

First, good for you for ending an abusive relationship. There is NEVER a valid reason for committing abuse.

What you need to do now is consult with a family law attorney to discuss the possibility of obtaining spousal support from your ex-husband. Contact the Superior Court for your county to learn what low-cost resources may be available to you. Many courts have very useful websites, with a family law self-help section for information and referrals.

Best of luck to you.
