subway,forgot ticket- california penal code 640

According to california penal code 640- a person has 72 hours in which to prove that he had a discount ticket-then the citation will be voided.

Should the officer tell the people about this law when they are cited?

How else will they know about it?

Now a person is faced with a misdemeanor and a fine of at least $250.00 and community service - and this person already paid for a montly discount ticket.

Can this person bring this up when he sees the judge?

Sure. Request a hearing and bring proof to the judge that you had a discount ticket at the time of citation. He has the authority of reduce or eliminate the fine and may just do so.
