Legal Question in Civil Litigation in California

can i sue another driver

Another driver slammed their brakes on in front of me, causing me to hit them. Fortunately no one was hurt and there was no apparant damage other then minor paint transfer. I suggested we make a police report to document the minor damage, she refused. The next day she got a lawyer, saw a doctor and filed a police report. Since I hit her I was faulted, but she is claiming outrageous damages and injuries that my ins co says were not caused by me. Now she is suing me. Can I sue her for filing a bogus suit against me? And for all the stress this has caused me? I had to go to the hospital for heart related issues due to stress and anxiety? This took place in california.

Re: can i sue another driver

Tender the lawsuit to your insurance carrier. They will defend you and, if required, will pay the other driver. Your only liability might be an out-of-pocket deductible. Let the insurance carrier's attorney bear your burden, and don't be concerned about it.
