One can be exempt from the English portion of the test if developmentally disabled or if there is a mental impairment. A physician's opinion is required.

Also, persons who are over 50 and have been permanent residents for at least 20 years are exempted from the English requirement. Those 55 and permanent residents for for 15 years also are exempt from the English language requirement.

The Attorney General can in discretion waive history portion of test for those over 65 with permanent residence for 20 years.

This matter is complex and you should not try to do it yourself so you should get an attorney to discuss your options. If you are located in Southern California, you can email me your contact info, so we can discuss your particular situation. There is no charge for consultation.
