Had Failure Marriage, Wants to marry again!

I was married to American citizen in Nevada thru K-1 Visa but since I struggle so hard in our marriage for he live in lies and dishonesty, I decided to go back here in Philippines. But before I go back here, I met another man in NY who become my friend, we spent time together with his kids and I know him well for I stay with him. Infact, I do overstay 2 months before going home. Now, can I file annulment to my husband while I'm here in Philippines?Can I go back for second time thru K-1 Visa and marry the man in N.Y who I felt inlove with? Will the INS put pressure on me about my first marriage that never works out?

Instead of filing a petition in the Philippines for THE annulment of your marriage, it would be best if you would just convince your husband to divorce you in the US.
