Filing petition for an adopted child

I adopted a child from india in '94 and want to bring her to the United States. I lived with her from '90 to '92 and then in '92 I came to USA and left her in the care of my sister and her husband. I went back to visit her occasionlly. I'm now a US Citizen and want to petiton for her. At the time of adoption she was 6 and now she is 17 years old. I need to know the process of filing the petition and how long it will take for her to get here.

I have done cases like that. You need to show that atleast 2 years adopted parent took care of the child. You should have documentation that the school records in india identify you as the guardian, etc. Now...you should apply I-130 for the child...it takes about 8 to 12 months for the process.

An adoption of a a foreign child by a U.S. Citizen must be done before the child turns 16. It is possible to bring the adopted child to the U.S. through a Petition to Classify Orphan as a Child. Please contact our offices for further information.
