Legal Question in Immigration Law in California

After filing a petition for an alien relative spouse, how long before they will be able to obtain a license and work? Is there a waiting period after marriage?

Assuming that you are a USA citizen and your spouse came to USA lawfully on a visa and otherwise eligible for adjustment of status, they will need to apply for adjustment of status in order to be able to file also an application for a work permit. Typically, a work permit is approved and issued in 2-3 months after the whole application package is submitted to the USCIS.

There is no waiting period after the marriage.

There's no waiting period after marriage. Once an application for adjustment of status is filed (assuming your wife is qualified), it takes several weeks up to three months by regulation.Rarely does the government take longer to process these cases and normally it takes less time.

The USCIS takes approximately 90 days to issue an employment authorization card upon submitting your I-130 petition for alien relative and other relevant applications. Once your spouse receives a work permit he/she can obtain a social security number. There is no waiting time requirement to submit your I-130 petition and application for adjustment of status. You can submit your documents to the USCIS once the marriage takes place.
