Dear Inquirer:

You should concurrently file an I-765 with the adjustment of status application, even though working without permission is not a bar to her adjustment of status if you are a US Citizen.

I recommend that you email [email protected] or visit www.hanlonlawgroup.com if you would like to schedule an appointment for a confidential consultation to discuss this matter further.

This matter is complex and you should not try to do it yourself so you should get an attorney to discuss your options. If you are located in Southern California, you can email me your contact info, so we can discuss your particular situation. There is no charge for consultation.

No, it's not required, but to get a social security number for a person who doesn't have one, that application is required unless you wait until permanent residence is approved. Even children apply on the I-765 to get a SS#.

I would be happy to help you out if you contact me offline. Check me out at http://www.yardum-hunter.com, fill out a consultation request there at http://www.yardum-hunter.com/Main/Consultation.asp or email me at [email protected]. Until then, please don't rely on this as legal advice.

Your wife can file an I-765 to request work authorization. This can be filed with the 485, or afterwards. They do not have to be filed together.
