Immigration - B2 Extension

I got a 6 months stay on JFK Airport on 7th Feb 2007. I have filed for a B2 extension on 20th July 2007. How long does it take for the USCIS to reply the Approval or Denial of the Extension? How long can i legally stay in the country? If my application for extension gets denied then how much time do I get to leave the country.

You should have an answer within the next 180days. You are not technically unlawfully present (illegal) during the pendency of the application. (Called a Period of stay authorized by the Attorney General). However, if the extension gets denied, the date reverts back to the date of the original expiry making you unlawfully present during the time. There are many issues involved with unlawful presence. For example if unlawfully present for more than 180 days, you might be barred reentry for 3 years and if for more than 365 days, ten years. Also if you have a multiple entry visa, this visa might be revoked by operation of law. Those are only few issues. You should look into other kinds of visas namely employment based or even other ways to apply for a greencard. Our office has successfully handled many of those.
