Legal Question in Immigration Law in California

Married us citizen

I came legally 10 years ago my girlfiend is 18 and we have a baby, got married 1 month ago.

A lawyer told me that she needs to make 21 thousand dollars a year but im the one that works, she doesnt, and i dont have anyone that could a sponsor or a support.

I don't know all the facts, but from what I can conjecture, your income may be used -- however, if she has no income, then she cannot technically "support" you if you end up without income -- and that is the purpose of the I-864 Affidavit. I suggest you talk with her parents, your parents, or someone who knows you well and see if they would be a joint sponsor. Call my office if you have any other questions for a consultation.

Your wife needs to file the affidavit of support, but since she can't meet the poverty guideline, your income can be used toward meeting the guideline; that's not a problem.
