Legal Question in Immigration Law in California

I have over-stayed my student visa for many years and now. I have been working and paying taxes. Now I have a job opportunity in my home country, which I'm considering accepting. However, I'm told that even if I leave voluntarily now, I will be barred from re-entry for 10 years.

What are my opti0ns as I'd like to return in a few years at the latest? I came to the US on a scholarship and have a good education.

I'm also told that my only option is marriage. There is the possibility of marriage with my current partner, who is a citizen of the US; however, that would likely take place in 2013 at the earliest, but if I take this new job, I will have to leave by mid-2012.

Any help would be greatly appreciated.

You are correct that once you leave the U.S. you will be barred from coming back for 10 years. Marriage would allow you to get a green card because marriage to a U.S. Citizen will provides a waiver to your overstay under the current law. There may be other options depending on your individual circumstances you should collect your immigration paper work and immigration history and sit down with an immigration attorney to see if any other options are available.
