Legal Question in Insurance Law in California

I have a neighbor whose pit bull dog ate through his fence and came into my yard. I went to inform him and I fell on an icy patch on hid walkway. I hurt my back and shoulder, needed medical attention, xrays and a shot for pain. When l let him know what happened .hr admitted the walkway gets icy. He won't give me renters insurance info but admitted they have it. What can l do to obtain this info for a claim?

Send him a letter formally demanding that he compensate you. List your medical expenses (if you don't have complete information yet, tell him what you know and explain what is still in the pipeline), lost income, and any other losses. Describe your pain. And tell him you will have to sue if you and he can't come to an agreement. He will probably give the letter to his insurer, and they will contact you.

If you don't hear from the insurer in a few weeks, send a follow-up letter. If that still doesn't get you results, you may need to file a lawsuit. You will then be able to demand his insurance information in discovery.

Please note that my answer presumes you have plenty of time before the statute of limitations runs out. But your question doesn't say when you were injured, so I don't know how much time you have left -- if any. You may not have enough time to take all the steps I have suggested.

Your best bet is probably to meet with a lawyer ASAP and discuss your rights. You might also want to have the lawyer write your demand letter, since letters from lawyers tend to be taken more seriously.
