Legal Question in Insurance Law in California

uninsured driver, got hit

I was driving my girlfriends car, but i am excluded from her policy. I made a legal left turn and a car on the other lane decided to switch lanes, (to avoid the truck in front of him signaling to make his left turn) after i made my turn and hit the rear right bumper of the car i was driving. What rights if any do i have? His insurance company claims it's all my fault, which i do not think it is. There was only one witness, which was his passenger. should we dispute this in court? please help!

I would need a lot more facts before I could tell you that. What I can tell you is that you may want to go to my blog, www.calpiblog.com, and read through the auto insurance posts about how the insurance company will act if you are uninsured. Remember, your girlfriend may be liable for the damages as the car owner as well.
