Legal Question in Intellectual Property in California

I want to post a story on my website: Hans Christian Andersen's "The Emperor's New Clothes".

Is this possible? Would I have to pay for any rights or the like?

The story is very old (1837), but of course I would probably use an existing (more recent) translation.

Is it different if I write the story in my own words?

If you retell the basic story in your own words, rather than using the words of a translator who may hold a still-valid copyright, you reduce your risk substantially.
