Legal Question in Landlord & Tenant Law in California

elderly and disabled building landlord responsablity

My mother lives in a building for only elderly and disabled persons .It is a large building with onsite management.Recently ,they have started telling tenants who are locked out of their apartments to call a locksmith.Do they have any responsiblity either as an acredited senior building or because it was a past amenity to let tenents into their apartments when they are locked out.

Re: elderly and disabled building landlord responsablity

Sorry for the attorney response, but it depends on the rental agreement.

There are special regulations for locations that are specifically elderly CARE facilities, but this does not sound like it is the situation here.

If you would like, we can look into this matter further by reviewing the lease agreement and seeing if they are required to follow the regulations.

In a rent control jurisdiction, this could be considered a reduction of services and justify a rent reduction. Otherwise the terms of the lease govern.

You might consider having your mother pin a spare key to the inside of her garment to avoid the need for a locksmith.
