Ending Lease Early - Saratoga, CA

Hi,

I moved into my cottage on a 11 month lease September 2012 , utilities were included in the rent (internet, water, gas and electricity). Rent ($1400)has been paid on time every time and never withheld. In the Craigslist ad there was a picture of the property. It was clean and in immaculate condition. When I viewed the property there was garbage and debris everywhere on the outside of the unit. The landlord assured me that it would be cleaned up. We signed the lease. That same month I was without water for 4 days. The landlord was in a feud with the tenant in the main house my cottage is attached to and decided not to fill the water tanks that supply domestic water to the main house and the cottage. October rolls around I asked once again to have the debris and garbage removed and was given the run around. Garbage was not removed until mid-January. During the end of January the propane tank ran out therefore I had no hot water for over a week. I also just found out through my research that there is supposed to be a working heater/furnace in the cottage. The unit has no heater/furnace. When I mentioned these problems to the landlord in an e-mail his response was that I had 30 days to vacate. Do I have any recourse?

You may have some cause for habitability issues... He may be constructively evicting you based on his actions. If you are having so many issues you may not want to live there.
