If the tenant is engaging in conduct that is illegal or otherwise prohibited by the lease, then you can evict him or her. Generally, you start with a notice to vacate the premises and, if the tenant stays, to bring an unlawful detainer action.

You need a reason to evict a tenant, prior to the expiration of a lease term. Such reasons include illegal or prohibited conduct, creating a nuisance, destructive behavior, non-payment of rent, and others.

You sound like you need some help. Check the internet (or this site) for real estate attorneys in your area.
