Legal Question in Landlord & Tenant Law in California

Evicting Disabled person

I was given a 3 day notice and I am unable to pay rent so I am having to move out. How long do I get to move my stuff? Can the landlord have me locked out if I don't pay her rent? Can she keep my stuff?

Re: Evicting Disabled person

At the end of the three days you are supposed to have totally vacated the rental unit, which includes removing all of your stuff. The landlord can move it out of the unit and put it into some sort of storage area; probably the best would be to remove all breakable and valuable items your self and arrange for the landlord to store at no charge the rest until a reasonable time yuo two decide on for you to pick it up. You should gilve her a list of what the items are that you are leaving for storage, taking pictures would be best. Often there are disputes as to exactly what was left and its condition. Find out if she will dump what you want to throw away and take to a neraby charity association what yo want to donate. Point out by helping you, since you are disabled, she gets the unit vacated faster and it can be rented sooner. Once it appears you have really left, she can change the locks. If it appears you have not left, she can not change the locks but you would owe rent for the time until you are clearly out.
