Legal Question in Landlord & Tenant Law in California

Housing authority Threw away satellite dish on rented home

We installed a satelite dish on our roof. The Housing assosiation today reroofed our complex and took down the dish and had it thrown away. We recieved no written notice of this reroofing, the inconvence it was going to cause to us or any notion that our dish was going to be thrown away.

Now my lease it stated that we were supposed to recieve a list of HOA rules and regulations. We to this date have not recieved those rules and regs. The president of the association, said that our landlord was notified 3 months ago of the reroofing and that all dishes would have to be removed. We were never forwarded this information.

Is the property ours even though it is attached to their roof, and would throwing it away constitute theft. Can we charge back the landlord for any costs incurred to putting the dish on say the patio. Is not recieving the rules and regs and not informing us of the inconvienience neglegence on their part and grounds to get out of the lease.

Re: Housing authority Threw away satellite dish on rented home

from the facts given so far, you DEFINITELY appear to have several tortious causes of action available to you for recovery of damages here, either against your landlord and/or the HOA.

if you would like further legal assistance and/or representation in this matter, please email my office directly with more detailed information and how you would like to proceed in this unfortunate matter. we will do everything in our power to help ensure you receive justice here. also, please include a summary of all the damages (i.e. satellite dish expense, etc..) that you are out of now due to the acts of the HOA and/or your landlord.
