landlord/tenant

Tenant was susposed to move out the 1st feb . didnt move , is three months behind in rent, will not return calls. What are my optitions? I want them out

I assume for purposes of your question that the property is located in California and you live in Arizona. A 3 day notice to pay rent or quit should be served, then an unlawful detainer can be filed. Please contact us if you have any other questions concerning the eviction process.

You must serve a 3 Day Pay or Quit notice on the tenant for all the back due rent. They will either have to pay you in full, or face an eviction action.

I suggest you let an attorney do the notice and service. After this long a period you don' want to have either the content of the 3 Day Pay or Quit notice or the service mishandled since that document is the basis on which the Court is granted jurisdiction over the eviction case.

It is not clear whether your property is in California or Arizona. I am notlicensed in Arizonand do not know Arizona law.

If the property is in California you should serve a three day notice on the tenant so that an unlawful detainer ( eviction) procedure can be started.

If your property is in CA, you serve a three-day notice. If they don't pay within the three days, then you file an unlawful detainer lawsuit to get them out. If the property is in the San Francisco area, let me know if I might be of assistance. Thanks.
