Legal Question in Landlord & Tenant Law in California

Returning my apartment before the 30 day notice

I have inform my landlord that i will be leaving his apartment. And he told me that because i did not tell him 30 days prior. He said that i won't be getting back my deposit money. Is he on his right to keep my deposit money if the apartment is in good conditions to rent out?

I can't answer specifically without more facts.

A lot depends on what kind of lease you had, how long, was it written, was it month to month, etc.?

Assuming you were on a month to month, you must give landlord 30 days notice. He would be entitled to keep part of the deposit for unpaid rent.

However, if the apartment is clean and ready to rent to another, he has the duty to rent it as soon as possible and not charge you for whatever days during the 30 days he is able to recoup money from a new tenant.

You are more than welcome to e-mail me, or call me, with additional facts, which might change my answer.
